OVERVIEW
Welcome to Unhinged Decor. The terms “we,” “us,” and “our” refer to Unhinged Decor.
Unhinged Decor operates this website and online store, including the information, content, features, tools, products, and services offered through it (collectively, the “Services”). Our store is powered by Shopify, which provides the ecommerce platform that enables us to offer our products and Services to you.
These Terms of Service (“Terms”) describe your rights and responsibilities when you access or use our Services.
By visiting our website, purchasing from us, or otherwise using our Services, you agree to these Terms and our Privacy Policy. If you do not agree with these Terms, you should not use the Services.
SECTION 1 — ELIGIBILITY AND ACCOUNTS
By using the Services, you represent that you are at least the age of majority in your state or jurisdiction of residence, or that you have obtained any consent required for your minor dependents to use the Services.
You may be required to provide information including your name, email address, billing information, payment information, and shipping address.
You agree that information you provide is accurate, current, and complete.
If you create an account, you are responsible for maintaining the confidentiality and security of your account credentials and for activity occurring through your account.
SECTION 2 — PRODUCTS
Many Unhinged Decor products are made to order after an order is placed.
We make reasonable efforts to accurately display and describe our products. However, colors, dimensions, print placement, and appearance may vary slightly because of differences in screens, devices, manufacturing, and printing processes.
Such normal production variations do not necessarily constitute a defect.
Product descriptions, pricing, designs, availability, and specifications may be changed without notice.
We reserve the right to discontinue products, limit quantities, or restrict sales to particular persons, geographic areas, or jurisdictions where permitted by law.
SECTION 3 — ORDERS
Submitting an order constitutes an offer to purchase products from Unhinged Decor.
We reserve the right to accept, reject, limit, or cancel an order where permitted by law, including because of suspected fraud, pricing or listing errors, product availability, payment issues, or fulfillment limitations.
Payment must be successfully processed before an order can be fulfilled.
Please review your order carefully before submitting it, including the product, design, size, color, quantity, and shipping address.
Orders may be cancelled within 15 minutes of being placed through any cancellation option we make available.
After the 15-minute cancellation window, an order may have entered production. Because many of our products are made to order, cancellation cannot be guaranteed after that time.
Returns, exchanges, replacements, and refunds are governed by our Return and Refund Policy.
SECTION 4 — PRICES, PAYMENT, AND BILLING
Prices, discounts, promotions, and product availability may change without notice.
The price charged will be the price displayed and accepted at the time your order is placed, subject to correction of obvious pricing or listing errors where permitted by law.
Unless otherwise stated, displayed product prices do not include applicable taxes, shipping charges, or other charges that may be calculated during checkout.
You agree to provide current, complete, and accurate billing and payment information.
You represent that you are authorized to use any payment method submitted in connection with an order.
SECTION 5 — SHIPPING AND DELIVERY
Most Unhinged Decor products are made to order, so orders may require production time before shipment.
Production and delivery estimates are estimates only and are not guaranteed.
Shipping times may vary based on the product, fulfillment facility, destination, shipping method, carrier conditions, weather, holidays, and circumstances outside our reasonable control.
Products within the same order may be produced at different facilities and may arrive in separate packages or on different dates.
When available, tracking information will be provided after shipment.
Customers are responsible for providing an accurate and complete shipping address. If you discover an address error, contact us immediately at support@unhingeddecor.com. We cannot guarantee that an address can be changed after an order enters production or ships.

SECTION 6 — RETURNS, REFUNDS, AND PRODUCT ISSUES
Because many of our products are made to order, we generally do not accept returns or exchanges because of:
• Incorrect size or color selection by the customer
• Change of mind
• Buyer’s remorse
• Accidental orders after the applicable cancellation period
• Normal minor variations associated with printing or manufacturing
If an item arrives damaged, defective, misprinted, or materially different from the item ordered, contact us at support@unhingeddecor.com within the period specified in our Return and Refund Policy.
We may request photographs, your order number, and other information reasonably necessary to evaluate the issue.
Approved claims may be resolved through a replacement, refund, or other appropriate remedy, subject to applicable law and our Return and Refund Policy.
Nothing in these Terms limits rights or remedies that cannot legally be excluded.
SECTION 7 — INTELLECTUAL PROPERTY
The Unhinged Decor website and its content, including designs, artwork, graphics, text, photographs, logos, branding, product designs, videos, and other materials, are owned by or licensed to Unhinged Decor and are protected by applicable intellectual property laws.
You may use the Services for personal, non-commercial purposes.
Except as permitted by law or with our prior written authorization, you may not copy, reproduce, modify, distribute, sell, republish, commercially exploit, or create derivative works from our protected content.
Unhinged Decor names, logos, designs, product names, slogans, and other brand elements may constitute trademarks or other protected intellectual property and may not be used without authorization.
Third-party trademarks appearing on the Services remain the property of their respective owners.
SECTION 8 — OPTIONAL AND THIRD-PARTY TOOLS
The Services may provide access to tools, applications, payment processors, fulfillment providers, social platforms, or other services operated by third parties.
We do not control all third-party services and cannot guarantee their availability, accuracy, security, or performance.
Your use of third-party services may be governed by separate terms and privacy policies established by those providers.
SECTION 9 — THIRD-PARTY LINKS
The Services may contain links to third-party websites or resources.
We are not responsible for the content, accuracy, availability, products, services, policies, or practices of third-party websites.
If you access a third-party website, you do so subject to that third party’s terms and policies.
SECTION 10 — RELATIONSHIP WITH SHOPIFY
Unhinged Decor is powered by Shopify, which provides technology used to operate our online store.
Purchases made through our store are transactions between you and Unhinged Decor, not between you and Shopify.
To the extent permitted by applicable law, Shopify is not responsible for products purchased from Unhinged Decor or for claims arising solely from transactions between you and Unhinged Decor.
SECTION 11 — PRIVACY
Personal information collected through the Services is handled in accordance with our Privacy Policy.
Because our store is hosted using Shopify and may use other service providers, information may be processed by Shopify and other third parties that help us provide ecommerce, payment, fulfillment, analytics, communications, security, and related services.

SECTION 12 — REVIEWS, FEEDBACK, AND USER CONTENT
If you voluntarily submit reviews, photographs, comments, suggestions, ideas, or other content (“Feedback”), you represent that you have the right to provide that content and that it does not violate applicable law or the rights of another person.
To the extent permitted by law, you grant Unhinged Decor a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, adapt, and publish Feedback for purposes related to operating, improving, and promoting our business and products.
We may remove or decline to publish Feedback that we reasonably determine violates these Terms, applicable law, or the rights of others.
SECTION 13 — ERRORS, INACCURACIES, AND OMISSIONS
Occasionally, information on the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, availability, shipping charges, transit times, or other information.
We reserve the right to correct errors, update information, or cancel affected orders where permitted by law.
If an order is cancelled after payment because of an error on our part, any appropriate refund will be issued to the original payment method.
SECTION 14 — PROHIBITED USES
You may use the Services only for lawful purposes.
You may not use the Services to:
• Violate applicable laws or regulations
• Infringe intellectual property or other legal rights
• Submit fraudulent, deceptive, abusive, defamatory, or unlawful material

• Attempt unauthorized access to our systems or accounts
• Interfere with the operation or security of the Services
• Harvest personal information without authorization
• Engage in spam, phishing, fraud, impersonation, or deceptive conduct

• Commercially scrape, copy, or exploit protected portions of the Services except as permitted by law or authorized by us
We may restrict or terminate access to the Services when we reasonably believe these Terms have been violated.

Automated systems, bots, agents, or similar technologies accessing our Services must comply with applicable laws, these Terms, and technical restrictions we implement.
We may limit, block, or otherwise control automated access to protect the security, availability, intellectual property, customers, and operation of the Services.
Automated systems must not circumvent CAPTCHAs, access controls, rate limits, robot exclusions, or other technical measures intended to control automated access.

We may suspend or terminate access to the Services where permitted by law, including in response to fraud, abuse, security threats, unlawful activity, or material violations of these Terms.
Provisions that by their nature should survive termination will remain in effect, including provisions concerning intellectual property, liability, indemnification, and dispute-related matters.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
WE DO NOT WARRANT THAT THE SERVICES WILL ALWAYS BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR AVAILABLE AT ALL TIMES.
EXCEPT FOR WARRANTIES OR RIGHTS THAT CANNOT LEGALLY BE DISCLAIMED, WE DISCLAIM WARRANTIES, REPRESENTATIONS, AND CONDITIONS TO THE MAXIMUM EXTENT PERMITTED BY LAW.
Nothing in these Terms excludes warranties, consumer protections, or other rights that applicable law does not permit us to exclude.
SECTION 18 — LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, UNHINGED DECOR AND ITS AFFILIATES, OWNERS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES.
THIS INCLUDES, WHERE PERMITTED BY LAW, LOST PROFITS, LOST REVENUE, LOST DATA, OR SIMILAR LOSSES.
Nothing in these Terms limits liability that cannot legally be limited or excluded.
SECTION 19 — INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless Unhinged Decor and its affiliates, owners, officers, employees, agents, contractors, licensors, and service providers from third-party claims, liabilities, losses, damages, and reasonable expenses arising from your material violation of these Terms, violation of applicable law, or infringement of another party’s rights.
SECTION 20 — SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.
The remaining provisions will remain in effect.
SECTION 21 — WAIVER AND ENTIRE AGREEMENT
Our failure to enforce a provision of these Terms does not waive our right to enforce that provision later.
These Terms, together with policies and other terms expressly incorporated into them, constitute the agreement governing your use of the Services.
SECTION 22 — ASSIGNMENT
You may not transfer or assign your rights or obligations under these Terms without our prior written consent.
We may transfer or assign our rights and obligations in connection with a merger, acquisition, sale, restructuring, change in ownership, or other lawful business transaction, subject to applicable law.
SECTION 23 — GOVERNING LAW
These Terms and any disputes arising from them will be governed by applicable law in the jurisdiction where the business operating Unhinged Decor is headquartered, without limiting any mandatory consumer rights that may apply based on your location.
SECTION 24 — CHANGES TO THESE TERMS
We may update these Terms from time to time.
The current version will be posted on our website. Where required by law, we will provide appropriate notice of material changes.
Continued use of the Services after updated Terms become effective constitutes acceptance of those changes to the extent permitted by applicable law.
